			<content:encoded><![CDATA[<p>Nobody wants to disappoint President Obama on the eve of the holiday season, so all the stops are going to be removed in order to deliver a comprehensive health care bill to his desk by Christmas. White House Budget Director Peter Orszag reckons that procedural and political obstacles notwithstanding, a bill creating a new system of national health care will be ready for President Obama’s signature before the end of the year.</p>
<p>“We think we’re going to get this done before the end of the year. We need the Senate to move, and we need to move to conference,” he said, referring to the compromise bill that will need to be crafted and voted on by both houses before the President’s signature could make the legislation the law.<span id="more-1226"></span></p>
<p>The timing is getting tight if Orszag’s speculation is to be brought to pass. As indicated above, although the House of Representatives has passed one iteration of comprehensive health care coverage, the Senate must develop, debate and pass its own version, and then the two bills must be combined into one mutually agreeable bill by a conference committee. Then that bill must be approved by both houses of the legislature. Every step on that path is pocked with pitfalls and there is as yet a substantial bloc of Senators unwilling to travel onward if the road before them still ends at the “public option” or government-funded medical insurance.</p>
<p>As for precisely how the money to fund this overhaul is to be raised, the scheme’s sponsors are being coy. Senate Majority Leader Harry Reid, D-Nev., is huddling daily with various groups of the bill’s proponents to come up with a foolproof game plan for convincingly demonstrating to the President the fiscal feasibility of whichever of the various models are finally adopted and are delivered to his desk. Reid and his fellows admit that the legislation, no matter what the fine points, will carry a price tag no lower than $800 billion over 10 years. The Congressional Budget Office (CBO) must have huge skirts because everybody from Senator Harry Reid to President Obama is hiding behind them lately when it comes to articulating a reliable dollars-and-cents estimate of just how many commas the final figure will have.</p>
<p>In the end, there is little doubt that when the CBO announces the results of its ciphering, a way to pay for the plan will have been found. In fact, to evince the inevitability of the matter, all those bound and determined to shepherd this historic and humongous health care bureaucracy through Congress and onto the already bowing backs of the American people (more specifically, onto the middle class that as usual will bear the heaviest burden) are proposing a litany of new taxes whose revenue will be spent on providing free health care to the uninsured.</p>
<p>In addition to the Medicare tax increase described in The New American, the latest revenue-raising idea is called the “Cadillac Tax.”</p>
<p>This tax would be a 40-percent excise tax on high-end, or “Cadillac” benefits, of health plans available within the new system. As yet, there has been little support for this notion, but the bill’s advocates will not be dissuaded so easily.</p>
<p>An old familiar source of “easy money” is being suggested by some zealots of the socialized system — capital gains on the “wealthy.” The idea is that instead of a payroll tax increase as recommended by Senator Reid’s office, the new Medicare tax would be applied to the profit made from investments, the capital gains, of those earning above an as-yet unspecified threshold income. As one might expect this early in the game, the White House has refused to confirm its support for that strategy. “We have to see the package as a whole,” Orszag told the Bloomberg News Service.</p>
<p>Republican Senator Olympia Snowe, R-Maine, has collaborated with Senate Finance Committee Chairman Max Baucus on a project to raise the required revenue by increasing the Medicare tax only on those objects in “health-related” areas. Given that most members of Congress are attorneys, there is sure to be unprecedented wrangling over just what is or isn’t related to health care.</p>
<p>If the legislature’s penchant for broad interpretation in other areas is a reliable guide, then there are sure to be very few aspects of daily life that aren’t somehow associated, no matter how tenuously, to health care. After all, most departments and agencies promulgated by Congress are justified constitutionally as being a part of “commerce,” so it isn’t a stretch to anticipate Congress will employ this skill anew in a quest to find connecting lines, no matter how faint, between any available source of money and health care.</p>
<p>Finally, in a tactic calculated to put capitalist gild on the collectivist lily, President Obama pointed Thursday to the results of a study conducted by the Business Roundtable, a cadre of blue chip company heads, into the monetary minutiae of health care reform. Antonio Perez, CEO of Eastman Kodak Company, speaking for the group, told news agencies that “reform done wrong won’t work and could make a bad situation much worse, in which case Business Roundtable could not support the bill.” That is not to say that they don’t think that reform can’t be done right, however. In fact, the report released last week indicates that most of these industry executives believe that many of the proposals currently being bandied about by Senators and Obama insiders could actually lower the net cost of health care per taxpayer.</p>
<p>Congress and the White House have pledged to cooperate with the Business Roundtable and assimilate their collected financial savvy into a legislative package that provides health care to all Americans. Never one to disregard a political bedfellow, no matter how strange, Obama repackaged the Roundtable’s findings and remarked that he interpreted the report as the country’s largest employers making it “clear the steep price that American businesses stand to pay if we fail to act.” The unvarnished truth of the matter is that no matter who ends up paying, the price will be steep and the climb to the summit will be forced.</p>
<p>No matter what the federal government proposes, our state must step up to the plate and have in place an Opt-Out plan that will be introduced in the next Legislative session.</p>
<p>This plan will be submitted in the following language form called the “Freedom of Choice in Health Care Act.</p>
<p>“Because all people should have the right to make decisions about their health care, no law shall be passed that restricts a person’s freedom of choice of private health care systems or private plans of any type. No law shall interfere with a person’s or entity’s right to pay directly for lawful medical services, nor shall any law impose a penalty or fine, of any type, for choosing to obtain or decline health care coverage or for participation in any particular health care system or plan.”</p>

			<content:encoded><![CDATA[<p>Sen. Tom Coburn continued his attack on Senate health care legislation on Wednesday, saying it would create dozens of new government programs that would be administered by thousands of new federal employees.</p>
<p>“If you don’t think that will put government between you and your care, you have no understanding of health care in America,” the Oklahoma Republican said during the third day of Senate debate on a bill to overhaul the nation’s health insurance system.<span id="more-1223"></span></p>
<p>The Senate was consumed by hours of debate on Wednesday, but held no votes on amendments since Republicans blocked the action.</p>
<p>Democratic leaders accused Republicans of stalling and said they were willing to stay in session through Christmas to get the bill passed by the end of the year.</p>
<p>Coburn, who said on Tuesday that seniors would “die sooner” if the bill is passed, continued on Wednesday to argue that the bill would lead to health care rationing, with key decisions made by “government bureaucracies.”</p>
<p>Counting Medicare, Medicaid and veterans’ and American Indian care, the government is already involved in 61 percent of health care in the United States, Coburn said. If the Senate bill passes, he said, that would rise to 76 percent.</p>
<p>Coburn said it was “arrogant” of lawmakers to believe that they knew best how to improve the system.</p>
<p>But Sen. Jeff Merkley, D-Ore., said it wasn’t arrogant to try to help people get health insurance. He said a recent study concluded that 44,000 people die each year because they lack health insurance.</p>
<p>“It’s not arrogant to fight for fundamental access to health care,” said Merkley.</p>
<p>And Sen. Sheldon Whitehouse, D-R.I., said opponents of the legislation complaining about government bureaucracies don’t have a problem with private insurance company bureaucrats who have “a profit motive to deny you care.”</p>
<p>Coburn, a physician, said he doesn’t like most of the insurance company representatives he has to deal with in his practice. But he said they do return his telephone calls.</p>
<p>“I never get a call back from Medicare,” he said. “The state doesn’t call me back on Medicaid.”</p>

			<content:encoded><![CDATA[<p>U.S. Senator Bob Casey (D-PA), a member of the Health, Education, Labor and Pensions Committee today introduced an amendment to protect and ensure health care coverage for low-income children.  The amendment would, in part, continue full funding for the Children’s Health Insurance Program (CHIP) through 2019, ensure affordable coverage and high quality benefits for children and make it easier for families to enroll in the program.</p>
<p>“We have had some victories in the effort to prevent the dismantling of CHIP, but there is more work to do in order to preserve and improve health care coverage for children,” said Senator Casey.  “My amendment to the Senate health care reform bill will strengthen coverage for children in CHIP through 2019 to ensure quality care for all vulnerable children. The benefits of health care for children, particularly low-income children and children with special needs, are beyond dispute.  Such care will not only help kids developmentally, do better in school and put them on a healthy path in life; it will also reduce long-term health care costs.”<span id="more-1220"></span></p>
<p>Specifically, Senator Casey’s amendment would:</p>
<p>•    Continue CHIP funding through 2019;<br />
•    Require a report in 2016 that will compare coverage and benefits for low income children under CHIP to the health care Exchange created in the reform bill;<br />
•    Increase federal matching funding for states that implement best practices for enrolling children;<br />
•    Protect children and families by ensuring, through 2013, that states may not reduce eligibility levels in place on October 1, 2009; will also require, beginning in 2014, that all states must cover children in families up to 250% of poverty;<br />
•    Streamline and simplify the CHIP application process to ensure families know about and can take advantage of coverage;<br />
•    Continue $50 million annual enrollment grants through 2019 to improve outreach to families about CHIP services and enroll children;<br />
•    Prevent eligibility errors by improving the eligibility screening process; and<br />
•    Dedicate any savings to be shared 50/50 between deficit reduction and a new fund for vulnerable children and families.</p>
<p>A detailed summary is included below.</p>
<p>Senator Casey has been a strong advocate for the Children’s Health Insurance Program (CHIP) since his father helped create the Pennsylvania program on which the federal program is based.  He was a leading advocate for the historic expansion of CHIP earlier this year.  And he has been a vocal opponent of the provisions in the original Finance Committee bill that would have dismantled the program.</p>
<p>Senator Casey spearheaded a letter signed by six other senators urging the Finance Committee to support the amendment by Senator Jay Rockefeller (D-WV) that preserved CHIP.  He recently hosted a widely-attended briefing on the importance of children’s health care.  Senator Casey gave numerous floor speeches on the need to do no harm to children in the health care reform debate.  And he actively lobbied his Senate colleagues and the White House on the importance of maintaining CHIP.</p>
<p>Summary of Casey CHIP Amendment</p>
<p>1.    CHIP continues with full funding through FY 2019. After the country accumulates real-world experience with the new coverage system established by reform legislation, Congress can make an informed decision whether to move CHIP children into the Exchange. In the meantime, the popular and successful CHIP program will continue to serve millions of low-income children, without forcing them into a new and untested system of coverage that would dramatically raise their health care costs and reduce covered benefits.</p>
<p>2.    In 2016, HHS reports to Congress about the difference between subsidized coverage in the Exchange and children’s coverage through CHIP. This report will inform Congress’ decisions about what happens to CHIP after 2019. If Congress decides to move CHIP children into the Exchange, this schedule allows time for a well-planned transition.</p>
<p>3.    States can count on federal CHIP dollars through FY 2019. From FY 2013 through FY 2019, states will qualify for federal matching funds whenever eligible children receive covered services. CHIP’s financial structure will thus fit with broader reform, in which Medicaid and Exchange subsidies are guaranteed without any rigid dollar limits in federal law. As a result, federal CHIP financing, like Medicaid and Exchange subsidies, will automatically adjust to changing conditions in each state, without artificial constraints locked into federal statute.</p>
<p>4.    States receive generous federal funding for all CHIP children. Starting in FY 2014, the federal government will pay between 88 and 94 percent of CHIP costs, depending on the state. To qualify for enhanced funding, states must implement recognized best practices for streamlining enrollment of eligible children.<br />
5.    Children can count on CHIP eligibility. Through FY 2013, states may not reduce CHIP eligibility below levels in effect on October 1, 2009. Beginning in FY 2014, all states must cover children up to at least 250 percent of FPL.</p>
<p>6.    Children can count on affordable access to essential health care. States may not increase CHIP costs charged to families, except to reflect increases in median income among low-income families after FY 2013. And if a state would cover a service for poor Medicaid children, it must offer that same service to CHIP children.</p>
<p>7.    Families can conveniently apply for children’s coverage using their federal income tax returns. Beginning in calendar year 2014, parents can ask for their federal income tax returns to be used to establish their children’s eligibility for Medicaid, CHIP, and subsidies in the Exchange. Unless there is reason to believe that the tax return information is inaccurate, it will determine eligibility whenever possible, without requiring families to complete additional, redundant paperwork. However, no tax information can be disclosed to health agencies unless such agencies have contractual or other legal obligations that, in the judgment of the Treasury Department, fully safeguard taxpayer privacy and data security.</p>
<p>8.    Outreach and enrollment grants begun by CHIPRA continue. Grants of $50 million a year will help community-based organizations and states enroll eligible children into coverage.</p>
<p>9.    Health subsidy programs gain access to the National Directory of New Hires (NDNH), which is the nation’s most comprehensive information about quarterly wage earnings and new hires. Programs like Food Stamps, Supplemental Security Income (SSI), and Unemployment Insurance already use NDNH to verify eligibility. By adding Medicaid, CHIP, and Exchange subsidies to the list of programs authorized to access NDNH, the amendment will prevent eligibility errors, safeguard program integrity, and increase the ability of program administrators to establish eligibility based on recent income data.</p>
<p>10.    Any net federal budget savings are shared, 50/50, between deficit reduction and a new Fund for Vulnerable Children and Families. The Secretary of HHS can use this fund to combat infant mortality, help low-income children with autism spectrum disorders and other disabilities, and provide health services (including mental health care) to children who are in foster care or homeless.</p>

			<content:encoded><![CDATA[<p>Senators prepared to cast their first votes today on health-care legislation, but even as partisan divisions hardened and contentious amendments stacked up, Democrats increasingly expressed optimism that they would succeed in passing a bill before Christmas.</p>
<p>The initial amendments offered illustrated the legislation&#8217;s vast scope and lingering vulnerabilities. The first, cosponsored by Sens. Barbara A. Mikulski (D., Md.) and Olympia J. Snowe (R., Maine), would increase preventive health care for women at a 10-year cost of $940 million. One aim of the measure is to blunt concerns raised last month when an independent commission recommended that women undergo mammograms less frequently.<span id="more-1217"></span></p>
<p>The second amendment, sponsored by Sen. John McCain (R., Ariz.), would strip out the bill&#8217;s primary revenue source, nearly $500 billion in Medicare cost savings. Although AARP and other seniors&#8217; groups have argued otherwise, Republicans are attacking the cuts as a threat to current benefits that could eventually shorten lives.</p>
<p>McCain told reporters, &#8220;They&#8217;ve paid all their working lives into the Medicare trust fund, and now they&#8217;re in danger of having $483 billion cut out of it, which would eventually lead to rationing of health care for seniors in order to fund a new, government-run health-care system in America.&#8221;</p>
<p>Other flash points expected to reach the floor in the form of amendments would target bill provisions related to abortion and illegal immigrants.</p>
<p>Senate Majority Leader Harry Reid (D., Nev.) said debate could continue through the weekend.</p>
<p>&#8220;I want people to feel that they&#8217;ve had an opportunity to understand the bill, offer whatever amendments they think will improve it,&#8221; he said.</p>
<p>Republicans are targeting key sections of the bill, including the nearly $400 billion in tax increases that would finance its 10-year, $848 billion cost. GOP lawmakers also are expected to propose significant changes to medical-malpractice laws.</p>
<p>To manage the expected deluge of Democratic amendments, Reid and other leaders are urging their colleagues to focus only on their top priorities for floor consideration.</p>
<p>One pending proposal would increase federal funding for residency training to relieve the cost burden on large teaching hospitals in states such as Pennsylvania, Florida, California, Illinois, and New York.</p>
<p>Sponsored by Sen. Charles E. Schumer (D., N.Y.), the measure would provide $2 billion in additional funding over 10 years to create an extra 2,000 residency slots nationwide.</p>
<p>Another group of Senate Democrats, including Sen. Bob Casey of Pennsylvania, is pushing improvements to the State Children&#8217;s Health Insurance Program. And a group of moderates, including Sen. Tom Carper of Delaware, is crafting language to strengthen cost-cutting programs.</p>
<p>Centrist Democrats, who are likely to decide the bill&#8217;s fate, appeared reassured by a Congressional Budget Office report rejecting insurance-industry assertions that the Senate measure would add thousands of dollars to the average family&#8217;s insurance bill.</p>
<p>The CBO found that Reid&#8217;s package would leave premiums unchanged or slightly lower for the vast majority of Americans who get coverage through their jobs.</p>
<p>A key moderate, Sen. Ben Nelson (D., Neb.), said he remained concerned about people who would face higher premiums. But he said he was more immediately focused on other problems in the package, including whether federal funds would directly or indirectly subsidize abortions.</p>
<p>Nelson said he would introduce an amendment similar to one the House adopted, barring the public plan that the bill would include from providing abortion services, while barring people who receive federal subsidies from using that money to buy insurance that includes abortion coverage.</p>
